Welcome to Mindful Essence! By attending classes (in-person or online), workshops, or using any of our services, and accessing our website, you agree to the following Terms and Conditions. These Terms and Conditions govern your use of our website (mindfulessence.com.au), services, and products offered by Mindful Essence. Please read these Terms carefully. If you do not agree to these Terms, do not use our website or services.

1. General

  • These Terms apply to all clients of Mindful Essence, whether participating in-person or online.

2. Services and Products

  • Mindful Essence offers a range of yoga classes, workshops, events, and wellness products (collectively “Yoga Services”). By purchasing or registering for any of our Yoga Services, you agree to comply with all relevant policies and guidelines associated with the Yoga Services.
  • Participants must be 18 years and over to partake independently in the class. Ages 16-18 years old must have a signed waiver and be accompanied by a parent/guardian. Below 16 years of age are not permitted to participate.

3. Website Use

  • Use the website only for lawful purposes and in accordance with applicable laws.
  • Do not disrupt or interfere with the website’s functionality or security.
  • Do not transmit harmful or illegal content.
  • Do not use the website for any fraudulent or harmful activities. 

4. Registration and Account Security

  • To participate in Yoga Services, you agree to provide accurate and complete clerical and medical information when registering, and agree to the waiver terms and conditions.

5. Health and Safety / Assumption of Risk

  • Yoga involves physical movements and physical exertion, including but not limited to stretching, balance exercises, strength-building, and other activities, which has inherent risks. As with any physical activity, there is an inherent risk of injury. These injuries could include, but are not limited to, muscle strains, sprains, or more severe injuries. By participating in yoga session either in-person or online, you confirm that you are in good health and able to take part in physical activities. You understand it is your responsibility to have clearance from a physician prior to attendance. By attending a session, you agree to take full responsibility for your participation.
  • Participation in yoga classes involves a mindfulness component including but not limited to techniques to induce relaxation, reduce stress and relief of muscular tension that may alter mental health status during participating in yoga.
  • The risks associated with participating in yoga, including changes in mental health and physical condition including but not limited to muscle strain, joint injuries, other physical injuries or deterioration of mental health status that may occur during classes.
  • Yoga is not a substitute for medical attention, examination, diagnosis or treatment. By participating, you agree to inform your instructor of any injuries, medical conditions, or limitations before class, and update your medical history and waiver form. That if I you are pregnant, become pregnant or you are post-natal or post-surgical, you will ensure you have a physician’s approval to participate. If you participate you agree you are participating at your own risk and will exercise caution in all activities, and that you are in good health and have no medical conditions that would affect your ability to safely participate in yoga classes. 
  • You are responsible to decide whether to practice yoga and participation is at my own risk.

6. Physical Limitations

  • You are responsible for your own body and for practicing within my limits and agree to adhere to the following recommendations.
  • If at any time during the class, either via the online live classes, prerecorded online classes or in person, you feel discomfort or strain, or dizziness you agree to gently come out of the posture, stop participating immediately and inform the instructor. 
  • You agree to rest at any time during the class if you feel it is needed. 
  • You agree to listen to your body and respect your limitations on any given day and not push beyond your abilities.
  • You understand that the yoga classes are for educational and fitness purposes only, and no specific results, including physical, emotional, or mental benefits, are guaranteed.

7. Release of Liability

  • To the maximum extent permitted by law, Mindful Essence, Jessica Farrugia, and any employees, agents, or affiliates are not liable for any and all liability, claims, demands, actions, or causes of action, whether personal or otherwise, arising out of or related to your participation in yoga classes whether in-person or online, including a private residence, inclusive of indirect, incidental, special, or consequential injuries, losses, or damages sustained during class, travel to/from class, or while on the premises where the class is held, or from use of our website or other services.

8. Bookings, Cancellation, and Refund Policy

  • Booking: all class and event bookings are subject to availability. You can book and pay for classes or events through our website.
  • Cancellations: classes are non-transferable and non-refundable. Classes must be cancelled or/or rescheduled at least 24 hours in advance to avoid forfeiting the class fee credits. A refund will not be issued for cancellations, but a credit will be offered to reschedule a class for a later date. A refund will only be issued with a medical letter informing that you are unfit to participate in yoga. Correspondence of your cancellation is to be completed by emailing mindfulessenceau@gamil.com. All rescheduled classes are to be completed via the customer portal.
  • Missed session(s): A missed one-on-one, online or in-person group sessions cannot be rescheduled or refunded without prior notice and agreement from the instructor >24 hours prior.
  • Expiration date: Each pass has an expiration date and must be used within 3 months of purchase. Unused sessions will not carry over beyond this date unless stated otherwise by the instructor.
  • Class Changes: We reserve the right to cancel or reschedule any classes or events at any time. In the event of a cancellation, we will provide a full refund or allow rescheduling, depending on the situation.

9. Pricing and Payment

  • All prices for classes, workshops, or products are listed in AUD (Australian Dollars) and are subject to change without notice.
  • Payment for services can be made through the available payment methods on our website.
  • Taxes may apply and will be added at checkout where applicable.

10. Video and Photograph Consent

  • By participating you acknowledge that photographs or videos may be taken during the class for promotional purposes. I consent to having my photo taken and to such use without compensation. If I do not wish to be photographed or filmed, I will inform the instructor prior to the class..

11. Online Sessions

  • Yoga sessions will be delivered via Zoom Platform, and I you take full responsibility for ensuring that you have a suitable device, internet connection, and safe space for participation. The instructor is not responsible for any technical issues that may occur on my end, including connectivity problems, device malfunctions, or interruptions.
  • Access to online classes is for registered users only. Sharing login information is prohibited..

12. Conduct and Behaviour

  • Arrive on time and you agree to follow the instructions provided during class, whether in-person or online. Late entry may not be permitted.
  • By participating you agree to respect other participants, the space, and the instructors during the sessions.
  • If participating in online sessions, you will ensure your environment is safe, private, and suitable for physical activity.
  • Mobile phones must be silenced or turned off during the session.
  • Respect the peaceful environment and other participants.
  • The studio reserves the right to deny service to anyone behaving inappropriately.

13. Confidentiality and Privacy

  • Your personal information will be collected solely for the purpose of managing bookings, providing services, and safety.
  • Your personal information will be handled in accordance with our Privacy Policy and will never be sold to third parties.
  • By using our website and services, you consent to our collection and use of personal information in accordance with our Privacy Policy.

14. Intellectual Property

  • All content on the website, including but not limited to text, graphics, logos, images, videos, and course materials, is owned by Mindful Essence and is protected by copyright laws.
  • You may not reproduce, distribute, or modify any content from the website without prior written consent from us. 

15. Acknowledgement of Terms

  • To participate in the yoga sessions you must read, fully understand and voluntarily sign the waiver and release of liability agreement and agree to the terms and conditions outlined above.

16. Governing Law

  • These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in Victorian courts.

17. Amendments to Terms

  • We reserve the right to update or change these Terms at any time. Any changes will be posted on this website, and the effective date will be updated accordingly. Your continued use of the website after changes are posted constitutes your acceptance of the updated Terms.

18. Force Majeure

  • Mindful Essence shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, strikes, or government action.
